Returns and right of withdrawal

Returns are arranged by email. Requests should be sent to hello@madetobenear.com, quoting the order number. The return address will be confirmed in reply.

1. Statutory right of withdrawal

Under Decreto-Lei 24/2014, the customer has a period of 14 days from the day on which the customer, or a third party designated by the customer, acquires physical possession of the goods to withdraw from the contract without giving any reason and without incurring any penalty.

Notice of withdrawal must be given within that period by means of an unequivocal statement. An email to hello@madetobenear.com is sufficient. The model withdrawal form set out in clause 8 may be used but is not obligatory.

Following notice of withdrawal, the goods must be returned within a further 14 days.

The customer may handle and examine the goods to the extent necessary to establish their nature, characteristics and functioning, including trying the garment on. The customer is liable only for any diminished value of the goods resulting from handling beyond what is necessary for that purpose.

2. Commercial return period

In addition to the statutory right of withdrawal, the seller offers a commercial return period of 30 days from the date of delivery.

Returns made after the expiry of the statutory period and within the commercial period are subject to the condition that the garment is unworn and unwashed, and that all original tags remain attached. These conditions do not apply to returns made in exercise of the statutory right of withdrawal under clause 1.

Goods purchased at a reduced price may be returned on the same terms as goods purchased at full price.

3. Costs

The cost of returning the goods is borne by the customer. The seller does not supply prepaid return labels. Use of a tracked service is recommended, and proof of postage should be retained.

Where the customer withdraws under clause 1, the seller reimburses the price of the goods together with the cost of standard delivery originally charged. Where the customer selected a delivery method more expensive than the standard option offered, reimbursement of delivery costs is limited to the standard rate.

Where the goods do not conform to the contract, all costs, including the cost of return, are borne by the seller.

4. Refunds

Refunds are made using the same means of payment used for the original transaction, unless the customer expressly agrees otherwise. No charge is applied in respect of the refund.

Refunds are issued within 14 days of the date on which the seller receives the returned goods, or of the date on which the customer supplies evidence of having returned them, whichever is the earlier. The time taken for the refunded amount to appear on the customer's account depends on the card issuer.

5. Exchanges

Exchanges are not offered. Customers requiring a different size should return the item in accordance with these conditions and place a new order.

6. Non-conforming goods

New goods are covered by a legal guarantee of conformity of 3 years under Decreto-Lei 84/2021.

Where goods are delivered damaged, are not those ordered, or otherwise fail to conform to the contract, the customer should notify the seller by email at hello@madetobenear.com, enclosing photographs where possible. The customer is entitled to have the goods brought into conformity by repair or replacement, or to an appropriate reduction in price or termination of the contract, at no cost.

This guarantee is separate from and additional to the periods set out in clauses 1 and 2.

7. Procedure

• Send an email to hello@madetobenear.com quoting the order number.
• The seller confirms the return address by reply.
• Return the goods within the applicable period, retaining proof of postage.
• The refund is issued in accordance with clause 4.

8. Model withdrawal form

Completion of this form is optional. A withdrawal may equally be notified by any other unequivocal statement.
